{"id":1124,"date":"2019-12-11T12:07:28","date_gmt":"2019-12-11T09:07:28","guid":{"rendered":"http:\/\/izmir.imece-der.com\/?p=1124"},"modified":"2019-12-11T13:18:31","modified_gmt":"2019-12-11T10:18:31","slug":"izmirin-kent-merkezinde-yeni-bir-kent-sucunun-parcasi-olmayin-insaat-ruhsatini-iptal-edin","status":"publish","type":"post","link":"https:\/\/www.imece-der.com\/?p=1124","title":{"rendered":"\u0130zmir&#8217;in kent merkezinde yeni bir kent su\u00e7unun par\u00e7as\u0131 olmay\u0131n.\u0130n\u015faat ruhsat\u0131n\u0131 iptal edin!"},"content":{"rendered":"<p><img decoding=\"async\" loading=\"lazy\" src=\"http:\/\/izmir.imece-der.com\/wp-content\/uploads\/2019\/12\/140-katl\u0131-bina.jpg\" alt=\"\" width=\"800\" height=\"450\" class=\"aligncenter size-full wp-image-1125\" srcset=\"https:\/\/www.imece-der.com\/wp-content\/uploads\/2019\/12\/140-katl\u0131-bina.jpg 800w, https:\/\/www.imece-der.com\/wp-content\/uploads\/2019\/12\/140-katl\u0131-bina-300x169.jpg 300w, https:\/\/www.imece-der.com\/wp-content\/uploads\/2019\/12\/140-katl\u0131-bina-768x432.jpg 768w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><br \/>\n\u0130zmir kent merkezinde 42 katl\u0131 ve 146 metre y\u00fcksekli\u011finde in\u015faa edilecek olan  projenin in\u015faat ruhsat\u0131 iptal edilmelidir. \u0130zmir B\u00fcy\u00fck\u015fehir Belediye Ba\u015fkan\u0131 Tun\u00e7 Soyer projeyi ve yap\u0131mc\u0131 \u015firketi  aklayan a\u00e7\u0131klamas\u0131yla kamuoyunda hayal k\u0131r\u0131kl\u0131\u011f\u0131 yaratt\u0131 ve kent su\u00e7unun orta\u011f\u0131 oldu..  \u015eehir Planc\u0131lar\u0131 odas\u0131 izmir \u015eubesi a\u00e7\u0131klama yapt\u0131.A\u00e7\u0131klama \u015f\u00f6yle;<\/p>\n<p>&#8220;\u0130ZM\u0130R\u2019\u0130N KENT MERKEZ\u0130NDE YEN\u0130 B\u0130R KENT SU\u00c7UNUN PAR\u00c7ASI OLMAYIN<\/p>\n<p>Son g\u00fcnlerde 146 yada 250 metre y\u00fcksekli\u011fiyle kent g\u00fcndeminin merkezine oturan \u201cZorlu Konak\u201d g\u00f6kdelen projesine ili\u015fkin ge\u00e7mi\u015fe d\u00f6n\u00fck incelemelerimiz do\u011frultusunda s\u00fcrece dair g\u00f6r\u00fc\u015flerimizi payla\u015fmak istiyoruz.<\/p>\n<p>Bahsi ge\u00e7en proje, \u0130zmir B\u00fcy\u00fck\u015fehir Belediye Meclisinin 14.12.2007 tarihindeki karar\u0131 ile uygun g\u00f6r\u00fclen ve onanan, 1716 ada 1,2,3,4 parseller ile 999 ada 81 parselin \u201cTicaret Se\u00e7enekli Konut Alan\u0131 (TM), Ye\u015fil Alan ve Otopark Alan\u0131\u201d olarak d\u00fczenlenmesine ili\u015fkin 1\/5000 \u00f6l\u00e7ekli Naz\u0131m \u0130mar Plan\u0131 de\u011fi\u015fikli\u011fi do\u011frultusunda Konak Belediye Meclisince 01.07.2008 tarihinde uygun bulunan ve \u0130zmir B\u00fcy\u00fck\u015fehir Belediye Meclisinin 10.11.2008 tarihinde onaylad\u0131\u011f\u0131 1\/1000 Uygulama \u0130mar Plan\u0131 de\u011fi\u015fikli\u011fine dayand\u0131r\u0131lmaktad\u0131r.<\/p>\n<p>Bahsi ge\u00e7en 1\/5000 \u00f6l\u00e7ekli Naz\u0131m \u0130mar Plan\u0131 De\u011fi\u015fikli\u011fi odam\u0131zca a\u00e7\u0131lan dava sonucunda \u0130zmir 2. \u0130dare Mahkemesi\u2019nin 02.10.2009 tarihli karar\u0131yla iptal edilmi\u015ftir. 21 Ekim 2009 tarihinde odam\u0131z\u0131n Konak Belediyesi\u2019nden ilgili parselin imar durumuna ili\u015fkin bilgi talebi olmu\u015ftur. Taraf\u0131m\u0131za 27 Ekim 2009 tarihinde iletilen cevap yaz\u0131s\u0131nda s\u00f6z konusu parsellere ili\u015fkin \u201c1\/5000 \u00f6l\u00e7ekli Naz\u0131m \u0130mar Plan\u0131\u2019na a\u00e7\u0131lan dava sonucunda y\u00fcr\u00fctmeyi durdurma karar\u0131 olmas\u0131 nedeniyle uygulamalar\u0131n durdurulmas\u0131 istendi\u011finden ve bunun yan\u0131nda s\u00f6z konusu parsellerin Belediye Enc\u00fcmenince d\u00fczenleme sahas\u0131 se\u00e7ildi\u011finden imar durumu verilemeyece\u011fi\u201d bildirilmi\u015ftir. \u00d6zetle 1\/5000 Naz\u0131m \u0130mar Plan\u0131\u2019n\u0131n y\u00fcr\u00fctmesinin durdurulmas\u0131ndan dolay\u0131 bu parsellerde uygulama yap\u0131lamayaca\u011f\u0131 belirtilmi\u015ftir. Ancak 999 ada 81 parselin de yer ald\u0131\u011f\u0131 1\/5000 Naz\u0131m \u0130mar Plan\u0131\u2019n\u0131n iptal oldu\u011fu 02.10.2009 tarihinden bug\u00fcne 1\/1000 \u00f6l\u00e7ekli Uygulama \u0130mar Plan\u0131 \u00fcst \u00f6l\u00e7ekli plana uyumsuzluk nedeniyle hi\u00e7 de\u011fi\u015ftirilmemi\u015ftir. Buna ra\u011fmen, 10.11.2008 tarihli Uygulama \u0130mar Plan\u0131\u2019na dayanarak Aral\u0131k 2018\u2019de bahsi ge\u00e7en projeye ili\u015fkin yap\u0131 ruhsat belgesi d\u00fczenlenmi\u015ftir.<\/p>\n<p>Ruhsat\u0131n verildi\u011fi tarihe kadar 1\/5000 \u00f6l\u00e7ekli Naz\u0131m \u0130mar Plan\u0131\u2019n\u0131n iptali \u00fczerinden 9 y\u0131l ge\u00e7mi\u015f ve bug\u00fcne kadar bahsi ge\u00e7en parseli de i\u00e7ine alan b\u00f6lgede d\u00f6rt kez Naz\u0131m Plan Revizyonu onaylanm\u0131\u015ft\u0131r. 2010 y\u0131l\u0131nda onaylanan planda s\u00f6z konusu alan \u201cMerkezi \u0130\u015f Alan\u0131\u201d, 2013 y\u0131l\u0131nda onaylanan planda \u201cMerkezi \u0130\u015f Alan\u0131\u201d, 2015 y\u0131l\u0131nda \u201cTicaret-Turizm Alan\u0131\u201d i\u00e7erisinde kalmakta olup bu \u00fc\u00e7 Naz\u0131m \u0130mar Plan\u0131 Revizyonu iptal edilmi\u015f ve 29.06.2018 tarihinde onaylanan son Naz\u0131m \u0130mar Plan\u0131\u2019nda da s\u00f6z konusu alan \u201cTicaret-Turizm Alan\u0131\u201d i\u00e7erisinde kalm\u0131\u015ft\u0131r. Y\u00fcr\u00fcrl\u00fckte olan Naz\u0131m \u0130mar Plan\u0131\u2019na davam\u0131z s\u00fcrmekte olup, 10.11.2008 onayl\u0131 Uygulama \u0130mar Plan\u0131\u2019n\u0131n kullan\u0131m karar\u0131n\u0131n TM (Ticaret Se\u00e7enekli Konut) olmas\u0131 nedeniyle \u00fcst \u00f6l\u00e7ekli plan ile uyumsuz oldu\u011fu g\u00f6r\u00fclmektedir. Dolay\u0131s\u0131yla Aral\u0131k 2018\u2019de verilen yap\u0131 ruhsat\u0131n\u0131n neye istinaden verildi\u011fi anla\u015f\u0131lmamaktad\u0131r.<\/p>\n<p>Alt \u00f6l\u00e7ekli plan ile \u00fcst \u00f6l\u00e7ekli plan aras\u0131nda uyumsuzluk var ise \u0130mar Kanunu\u2019nca i\u015fletilmesi gereken s\u00fcre\u00e7 a\u00e7\u0131k\u00e7a tarif edilmi\u015ftir. \u0130mar Kanunu\u2019nun 8. maddesinin d bendinde \u201cAlt kademe planlar\u0131n, \u00fcst kademe planlar\u0131n kesinle\u015fti\u011fi tarihten itibaren en ge\u00e7 bir y\u0131l i\u00e7inde ilgili idarece \u00fcst kademe planlara uygun hale getirilmesi zorunludur. Aksi halde, \u00fcst kademe planlar\u0131 onaylayan kurum ve kurulu\u015flar alt kademe planlar\u0131 en ge\u00e7 alt\u0131 ay i\u00e7inde uygun hale getirir ve re\u2019sen onaylar\u201d ifadesi yer almaktad\u0131r. Ancak 02.10.2009\u2019dan bug\u00fcne 1\/1000 \u00f6l\u00e7ekli Uygulama \u0130mar Plan\u0131\u2019n\u0131n uyumlu hale getirilmesi y\u00f6n\u00fcnde ne Konak Belediyesi ne de \u0130zmir B\u00fcy\u00fck\u015fehir Belediyesi\u2019nce bir ad\u0131m at\u0131lmad\u0131\u011f\u0131 gibi, plan uyumsuzlu\u011fu olmas\u0131na ra\u011fmen mevzuata ayk\u0131r\u0131 bir \u015fekilde ruhsat verilmi\u015ftir.<\/p>\n<p>Bu nedenlerle Kadifekale\u2019ye varan bir y\u00fcksekli\u011fin konu\u015fuldu\u011fu b\u00f6ylesi bir projeye \u0130zmir B\u00fcy\u00fck\u015fehir Belediye Ba\u015fkan\u0131 Tun\u00e7 SOYER taraf\u0131ndan olumlu bak\u0131lmas\u0131, ruhsat\u0131n kazan\u0131lm\u0131\u015f bir hak oldu\u011fu ve herhangi bir i\u015flem yap\u0131lmas\u0131n\u0131n do\u011fru olmad\u0131\u011f\u0131 y\u00f6n\u00fcndeki ifadeleri talihsiz buluyoruz. Bu proje TMMOB \u0130zmir \u0130l Koordinasyon Kurulu olarak ge\u00e7ti\u011fimiz ay ilan etti\u011fimiz \u201ckent su\u00e7lar\u0131ndan\u201d biridir ve hayata ge\u00e7irilmemelidir. Konak Belediye Ba\u015fkan\u0131 Abd\u00fcl BATUR \u201cProjenin durdurulmas\u0131 konusunda yap\u0131lacak bir i\u015flem olmas\u0131 durumunda projenin durdurulabilece\u011fi\u201d y\u00f6n\u00fcnde a\u00e7\u0131klamalar yapmakla birlikte hukuk birimlerinin bu konuyu ara\u015ft\u0131rd\u0131\u011f\u0131n\u0131 belirtmi\u015ftir. \u0130mar planlar\u0131ndaki \u00f6l\u00e7ekler aras\u0131 uyumsuzluk, imar durumu ve ruhsat\u0131n verilmesine ili\u015fkin daha \u00f6nceden yap\u0131lm\u0131\u015f mevzuata ayk\u0131r\u0131 i\u015flemler a\u00e7\u0131k olup bu ayk\u0131r\u0131l\u0131klara istinaden Konak Belediyesi taraf\u0131ndan gerekli i\u015flemlerin ivedilikle yap\u0131lmas\u0131n\u0131 bekliyoruz.
